Queally and Senior Counsel Tiffany Ackley secured non-suit in favor of the firm’s client, a national marketing organization for insurance companies based in Denver, on all causes of action in a jury trial in Orange County, California following the plaintiffs’ resting their case.
The plaintiffs alleged the firm's client was liable for the sale of $1 million worth of annuities claimed to be unsuitable by an insurance agent under the national marketing organization. The court ruled the plaintiffs had failed to make a prima facie case on any theory of liability and further failed to show a principal / agency relationship.
