San Francisco Partner Sara Moore Featured in Article on WARN Act Misconceptions

Gordon Rees Scully Mansukhani San Francisco Partner Sara Moore was interviewed for an article entitled "Experts debunk viral TikTok videos about how companies reveal layoffs," published by Axios.

The article examines how social media discussion around the Worker Adjustment and Retraining Notification ("WARN") Act is creating the misconception that employees are able to see layoffs via an online government portal in some jurisdictions before they happen.

"The likelihood that an employer is going to file without notifying their employees is very low," Ms. Moore explains. "If you were to monitor that portal, it's not as if there's going to be secret information that is being held there and withheld from employees." In reality, such information is not typically available to the public in advance and the criteria for whether layoffs even qualify for an official WARN Act notice are fairly complex.

Ms. Moore is the co-practice leader of the firm’s Northern California employment practice group. She regularly advises employers on how to navigate strategic personnel decisions, including complex reductions-in-force. Her practice includes defending employers in all stages of litigation as well as providing guidance on employee discipline/termination, disability accommodation, and wage and hour compliance.
