Adam J. Hiller is Co-Managing Partner in the GRSM Nashville office, spearheading the office’s Construction Litigation Group. As an experienced litigator in federal and state courts, Adam defends a broad array of clients in the construction sector, including:

  • Architects

  • General contractors and construction managers
  • Commercial property owners and developers
  • Subcontractors
  • Real estate agents and brokers
  • Environmental consultants
  • Property restoration service providers

Adam has represented construction clients in response to a wide range of claims, including breach of contract, construction defect, enforcement of mechanic’s liens, and alleged violations of the Tennessee Prompt Pay Act.  He has also successfully defended his clients against claims for malpractice, professional negligence, breach of fiduciary duty, and fraud. He has successfully resolved matters for his clients at the incipient stages of litigation as well as through dispositive motion practice and mediations.

Adam values building intimate client relationships through effective communication and close attention to detail. He strives to be inventive and to bring efficient and cost-effective methodologies to all aspects of legal representation. Adam’s ultimate goal is to assuage his clients’ concerns, instill confidence, and leave them with a sense of relief after every interaction.

Prior to joining GRSM, Adam worked at a national defense litigation law firm with a focus on construction litigation. He represented general contractors, construction managers and property owners in lawsuits brought in state court and handled all aspects of client interaction and case management from inception through resolution. He was involved in several mass tort actions, including In Re: Steam Pipe Explosion at 41st Street and Lexington Avenue and In Re: Gas Explosion Litigation 1644 and 1646 Park Avenue.

While in law school, Adam cultivated his litigation skills through oral advocacy and legal writing. During his third year of law school, he was a member of a three-person moot court team that advanced to the Brooklyn Regional Finals of the American Bar Association National Appellate Advocacy Competition. Also, during Adam’s third year, his student note was published in the law school’s Labor and Employment Law Journal.

  • Successfully argued an appeal filed by the plaintiffs before the U.S. Court of Appeals for the Sixth Circuit, which affirmed the U.S. District Court for the Middle District of Tennessee’s order granting clients’, a software company and its owner, motion to dismiss the plaintiffs’ complaint for failure to prosecute under FRCP 41(b).
  • Obtained a dismissal on a pre-answer motion to dismiss on behalf of clients, software developer and owner, in the U.S. District Court for the Middle District of Tennessee, for failure to prosecute under FRCP 41(b) in a case alleging copyright infringement and tortious interference with contract/business relationships.
  • Obtained a dismissal on summary judgment on behalf of client, a Tennessee attorney, in Tennessee state court in a lawsuit alleging legal malpractice by successfully establishing the suit was untimely as a matter of law since it was filed beyond the applicable statute of limitations.
  • Obtained a pre-answer dismissal on behalf of a client, insurance auditing company, in Tennessee state court in a lawsuit alleging professional negligence.  Also, successfully recovered a portion of the client’s attorney’s fees pursuant to TCA § 20-12-119(c)(1) for securing the dismissal.
  • Obtained a pre-answer dismissal on behalf of their clients, a Manhattan law firm and its partners, in a lawsuit arising out of the firm’s representation of a hedge fund in which the plaintiffs alleged several causes of action including: (1) violation of Section 10(b) of the Exchange Act [15 U.S.C. § 78j(b)] and Rule 10-b-5 promulgated thereunder; (2) fraud; (3) aiding and abetting fraud; (4) civil conspiracy to commit fraud; (5) negligent misrepresentation; and (6) negligence.
  • Obtained a pre-answer dismissal on behalf of their clients, a New York City law firm and its managing partner, in a lawsuit in which the plaintiff’s alleged legal malpractice arising out of representation before the New York State Workers’ Compensation Board and the plaintiff’s potential suit against a former employer.
  • Obtained a pre-answer dismissal on behalf of their clients, a Long Island law firm and its partners in a lawsuit in which the plaintiff’s alleged several causes of action including: (1) malicious prosecution; (2) prima facie tort; (3) abuse of process; (4) slander of title; (5) violation of New York Judiciary Law §487; (6) frivolous conduct; (7) tortious interference with contract and (8) tortious interference with prospective economic relations.
