Drawing on extensive courtroom experience—including more than thirty jury trials—Ben develops and implements case-winning litigation strategies tailored to client business goals. His practice emphasizes strategic dispute resolution, insider risk mitigation, crisis management, and cross-functional coordination with internal legal, compliance, security, and leadership teams.

Before entering private practice, Ben served as a Deputy District Attorney for Colorado’s 20th Judicial District, where he prosecuted complex felonies involving financial fraud, white collar offenses, and high-profile grand jury investigations. This prosecutorial background gives Ben a unique advantage in managing internal investigations, navigating regulatory inquiries, and building strong cases under challenging circumstances.

  • Obtained Rule 12(b) dismissal of claims against biotechnology company and its officers by prevailing on motion to dismiss in complex negligence and professional liability matter.
  • Obtained Rule 12(b) dismissal of 42 U.S.C. § 1983 deprivation of civil rights claim alleged against prison healthcare provider.
  • Prevailed in post-trial litigation and obtained significant remittitur of a nuclear verdict, or in the alternative, a new trial, in catastrophic personal injury case.
  • Negotiated expeditious and highly favorable resolution of state and federal anti-discrimination claims at the very outset of litigation, minimizing client impact.
  • Settled tort action for 15% of plaintiff’s mediation demand after deposing expert witnesses.
