Haley M. Heath is a Partner in the firm and a member of the Healthcare, Environmental & Toxic Tort, and Product & General Liability practice groups. An experienced litigator, Haley handles cases from inception through trial. She aggressively pursues her clients’ interests at every key step in the litigation process.

Haley has over a decade of successful experience defending clients in state and federal litigation. She has successfully litigated multiple multi-million-dollar cases. Haley is a general litigation attorney, handling all types of matters that come into the Arkansas office. Her specialties include medical malpractice defense, intellectual property litigation (including patent litigation), products liaibility, professional liability defense, and defense of civil sex abuse claims. Haley currently serves on the national counsel team for an asbestos defendant and has served as lead counsel for multiple skilled nursing facilities in Arkansas. Haley is well-versed in Arkansas’s Medical Malpractice Act, Arkansas’s rules and regulations governing the Office of Long Term Care, the Arkansas Residents’ Rights Act, and Arkansas tort reform. She is also well-versed in handling administrative matters in front of Arkansas’s various administrative boards of review. In addition to over a decade of successful courtroom experience, Haley has achieved complete summary judgment for multiple clients, eliminating the need for trial. Haley also has extensive experience taking and defending expert depositions.

Haley is also an accomplished appellate advocate, having successfully represented clients before the Arkansas Supreme Court and the Arkansas Court of Appeals. She also has extensive experience in administrative trials and appeals for professionals. Haley’s legal experience builds on years of training as a writer and advocate, including on her role as a law clerk for the Honorable Judge Bobby E. Shepherd of the United States Court of Appeals and on her role as Editor-in-Chief of the Arkansas Law Review. Haley was named one of Little Rock’s Best Lawyers for General Litigation in 2023 and 2024 by Soirée and a Mid-South Rising Star by Super Lawyers magazine in 2014-2024.

  • Stewart v. United States Environmental Services, Inc., (E.D. Ark. 2024). Obtained complete summary judgment on behalf of employer in a case alleging discrimination and retaliation under the ADA.
  • Swanson v. Wild About Learning, (Arkansas Circuit Court 2024). Obtained complete summary judgment on behalf of owner of daycare in individual capacity in case alleging negligence.
  • In re Wild About Learning (Arkansas Child Care Review Panel 2024). Obtained reversal of a DHS citation of a daycare related to alleged sexual abuse following a two-day trial.
  • Harris v. Warner Law Offices (West Virginia Circuit Court 2024). Obtained complete dismissal of defendant in action alleging libel and slander.
  • Westfield Insurance v. Sanchez (Arkansas Circuit Court 2024). Forced voluntary nonsuit following summary judgment briefing in subrogation matter.
  • White et al v. McDougal et al (Union County Circuit Court 2023). Forced voluntary nonsuit during summary judgment hearing following favorable questions from court in case involving ammonium nitrate explosion.
  • Robbie Brown et al v. David Byard et al (Arkansas Circuit Court 2023). Successfully opposed plaintiffs’ complaint for appointment of emergency receivership based on allegations of board member wrongdoing.
  • Lilly et al v. Barton-Lexa Water Association (Arkansas Circuit Court 2023). Obtained complete summary judgment on behalf of non-profit board accused of wrongdoing in operation of city’s water system.
  • Albert v. Crestpark Helena (Arkansas Circuit Court 2023) Lead counsel in two-week trial in which jury’s verdict beat the final demand by one million dollars and beat the ask of the jury by 40 million dollars.
  • McDougal v. Blann Tractor et al (Arkansas Circuit Court 2023).  Forced voluntary nonsuit following favorable depositions and summary judgment briefing in case involving ammonium nitrate explosion.
  • Estate of Daigle v. Spring Creek (AHLA arbitration 2022). Obtained complete defense judgment on behalf of long-term care provider in an action alleging medical malpractice and wrongful death following multi-day arbitration.
  • Braswell v. Windcrest Healthcare (Arkansas Circuit Court 2021).  Successfully moved for dissolution of temporary restraining order entered into against an assisted living facility.
  • Boyette v. HLNC, Inc (Faulkner County Circuit Court 2021).  Successfully compelled arbitration in a wrongful death suit against a long-term care provider.
  • Estate of Stafford v. Reliance Health Care (AHLA arbitration 2021). Obtained complete summary judgment on behalf of long-term care provider in action alleging medical malpractice and wrongful death.
  • Estate of Fred Cunningham v. Reliance Health Care (AHLA arbitration 2021). Obtained complete summary judgment on behalf of long-term care provider in action alleging medical malpractice and wrongful death.
  • Business World Inc. v. Wade Timmerman et al (Arkansas Circuit Court 2019). Obtained dissolution of temporary restraining order on behalf of defendant in action alleging violation of non-solicitation and non-compete agreements.
  • Miracle Kids Success Academy v. Maurrus (Arkansas Court of Appeals 2019). Prevailed on appeal of summary judgment related to unpaid promissory note.
  • Bad Boy Mowers v. Spartan Mowers (E.D. Ark. 2018).  Prevailed at claim construction hearing on all disputed terms in patent litigation.
  • Cozart v. Logue (Arkansas Circuit Court 2013). Obtained defense verdict after one-day jury trial regarding business dispute between former partners.
  • Carter v. Cline (Arkansas Supreme Court). Prevailed on appeal involving award of fees in breach of contract matter.
