Mark L. Bieter

Senior Counsel

Mark Bieter has more than 20 years of experience successfully solving problems for companies across industries in complex business disputes and corporate matters, such as breach of contract, breach of fiduciary duty, negligence, ERISA, and class action lawsuits. Mark has represented clients, including Fortune 500 companies, in federal court, state court, and governmental tribunals throughout the country.

Before joining GRSM, Mark practiced in Washington, D.C. for almost two decades with a large international firm, a boutique firm, and his own solo practice. He defended clients in high-value commercial litigation involving securities, partnership, and business disputes. He represented a Fortune 100 financial services company in several nationwide class action lawsuits involving allegation of ERISA violations, leading to successful results for the client.

Mark moved back to his hometown, Boise, and continues to represent clients in a variety of industries, including healthcare, finance, technology, and manufacturing. He frequently partners with in-house legal teams to develop and implement business-aligned legal and risk management strategies. He also serves as local counsel for clients working with in-house counsel to oversee cases and coordinate litigation.

A proud member of Boise’s Basque-American community, Mark serves on the board of directors of the Basque Foundation, Inc.

  • Defended regional hospital / healthcare system against claim for health benefits in federal court. Obtained partial dismissal of lawsuit, reducing potential damages by ~$1.5M (settled claim for $25k).
  • Represented major banking and financial services firm and its board of directors in a class action seeking $480 million in damages for alleged breach of fiduciary duty. Developed defense strategy that obtained partial summary judgment, reduced potential damages by ~$400 million, and led to settlement of all remaining claims on favorable terms on the eve of trial.
  • Led negotiations with opposing counsel on behalf of affiliates of U.S.-based global financial investment management and insurance company in ERISA class action seeking ~$200 million in damages for alleged breach of fiduciary duty. Developed litigation and negotiation strategy resulting in denial of class certification and withdrawal of complaint.
