The recent victory of San Francisco Partners Michael Lucey and Tad Devlin in a civil case alleging Stanford Hospital and Clinics were in violation of Section 502(a)(3) of the Employee Retirement Income Security Act of 1974 (ERISA) was profiled in the February 24, 2010 issue of The Voice, the weekly newsletter from the Defense Research Institute.
Michael and Tad successfully convinced the court that the plaintiff's attempt to circumvent the ERISA statute was improper and that the plaintiff could not cure her action by further amendment. The court agreed and granted the motion to dismiss, with prejudice and dismissed the claim.
