Calvin Davis, Co-Chair of Gordon & Rees's Franchise Practice, and a member of the California State Bar Franchise Law Committee, authored an article titled "Developments in Franchise Litigation" in the 2010 Annual Review of the
Business Law News published by the State Bar of California. Calvin's article analyzes the most important 2010 case law generated by disputes between franchisors and franchisees in five key areas of law: choice of law, enforcement of arbitration clauses, forum selection, personal jurisdiction, and failure to name an indispensible party. Nearly all of the cases covered in the article arose from attempts to enforce or avoid specific provisions in franchise agreements.
