The Fall 2010 FDCC Quarterly newsletter includes an article titled "Sex, Lies and Videotape: Cyber Liability Issues in a Digital World" prepared by Mercedes Colwin and Elizabeth Lorell. Mercedes and Elizabeth also made a presentation on the same topic at the 2010 Annual Conference of the Federation of Defense & Corporate Counsel ("FDCC"). The FDCC is composed of recognized leaders in the legal community who have achieved professional distinction and is dedicated to promoting knowledge, fellowship and professionalism of its members as they pursue the course of a balanced justice system and representation of those in need of a defense in civil lawsuits. Both Mercedes and Elizabeth are active in the Employment Section of the FDCC, where Elizabeth currently serves as its Chair.
The article addresses the first impression legal issues in state and federal courts that are being created by the explosive growth of social networking sites and computer-based platforms people use to express opinions and communicate. The article also identifies a variety of cyberspace-based platforms and how they can bring unwanted attention to a law firm and to clients. The article concludes with a set of “best practices” to help practitioners and clients navigate the pitfalls that often dot the terrain in cyberspace.
