This article explores two tentative per- and polyfluoroalkyl substances ("PFAS") settlement agreements by defendants 3M and DuPont, oppositions to these agreements, and potential impacts resulting from the approval of these agreements. The defendants were subject to claims for strict product liability, negligence, and nuisance arising from alleged design defects and failure to warn regarding the environmental hazards and toxic effects of PFAS in aqueous film-forming foam ("AFFF") for fire suppression.
