Environmental Compliance

GRSM brings a wealth of experience representing companies nationwide in environmental compliance matters, delivering outstanding results and efficient cost management. Our attorneys have extensive knowledge of regulations governing chemical products, including pesticides, herbicides, fungicides, and other related products, as well as the science, application, and industry practices associated with these chemicals. In addition, we assist clients with managing chemical exposure and business loss litigation, as well as environmental liabilities in the context of transactions, regulatory matters and litigation.

We handle commercial and corporate transactions, including supply and distribution agreements, testing and data development agreements, strategic alliance agreements and real estate transaction evaluations. We have extensive experience in due diligence, negotiation and drafting specialized environmental risk transfer mechanisms, and preparing contractual provisions and documents, including related representations, warranties and disclosures.

Our attorneys have experience handling federal and state regulatory compliance issues for all aspects of our clients’ businesses. We have substantial government regulatory compliance, contract review and regulatory counseling capabilities. We frequently represent clients in regulatory proceedings that require extensive negotiations to develop the most cost-effective permitting and soil and groundwater investigative and remedial strategies.

Our team works with the EPA, DOJ, Department of the Interior, U.S. Fish and Wildlife Service and numerous state regulatory agencies and local air pollution control districts regarding permit enforcement and citizen challenge proceedings, cleanup and abatement orders, cost recovery actions, natural resource damage claims, voluntary cleanups and the securing of no further action assurances.

Our attorneys are adept at addressing both federal and state issues involving site assessment, cleanup, regulatory compliance, administrative and judicial enforcement, and Superfund cost recovery and contribution claims.

We are well-versed in the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA), Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) and its state law equivalents. Our attorneys also have significant experience with the Resource Conservation and Recovery Act (RCRA), and the Oil Pollution Act (OPA).
