Bad Faith

GRSM provides practical and effective advice on extinguishing or diminishing extra-contractual claims, working closely with our clients to formulate strategies that bring contested matters to an efficient close. Our success hinges on litigating with precision and taking full advantage of alternative dispute resolution opportunities, including mediation and arbitration. We are particularly skilled at cutting to the core of a case and bringing it to closure. Our reputation in the legal community for subject matter knowledge means that we have credibility on our side. GRSM is also frequently engaged at the claims stage to provide advice to our clients as to avoid extra-contractual exposures, including with respect to stipulated judgments, assignments of rights, and otherwise.

Our experience spans the range of commercial general liability insurance, marine and non-marine property and casualty insurance, professional liability insurance, workers’ compensation insurance, life and health insurance and title insurance. We have worked with most insurers doing business in the United States, including small specialty insurers, mutuals, large companies, risk retention groups and foreign underwriters.

We are known for resolving claims with high potential exposure where an effort is being made to amplify the risk by criticizing the insurer’s handling of a dubious claim.

Our lawyers are also called upon to help resolve cases that have become mired in discovery or motion practice or where e-discovery costs or disputes have subsumed the original issues in the case.

Our lawyers understand the importance of resolving bad faith cases on terms that avoid creating cumulative exposure and we understand the need for our litigation positions to be consistent with our client’s business goals.

Our team includes former in-house counsel, former judges, and a former appellate court chief judge. We have helped to shape insurer guidelines and vendor relationships, as well as many of the policy forms in use today.
