On March 20, Gordon & Rees partner Jeffrey Lilly co-authored an article for Inside Counsel titled “The Growing Problem of Spoliation Sanctions.”
Lilly states that “The universal principles of fair play that are the bedrock of the spoliation doctrine, however, have evolved in recent years to a point where they are used as a tactic, a powerful weapon to create litigation about litigation, distracting courts and juries from the true merits of a lawsuit.”
Lilly is a partner in the Austin office and a member of the firm's Drug & Medical Device practice group. He is also co-chair of the firm's E-discovery practice group and is chair of a task force comprised of members of IADC, FDCC, DRI and ADTA which advocates for reasonable e-discovery rules and the application and interpretation of same.
