Philadelphia associate Katharine Thompson authored an article defining "trigger of coverage" and "number of occurrences" in insurance cases related to negligence claims against the Dioceses of Duluth by victims of priest sexual abuse that was posted in April on Gordon & Rees's Insurance Blog. Law360 contacted Thompson and requested to feature it as an Expert Analysis piece in their Insurance section. The article titled, "Defining Occurrences For Sexual Abuse Cases" was published on Thursday, April 27, 2017 in Law360.
In the article, Thompson discusses Diocese of Duluth v. Liberty Mutual Group et al., (a recent Minnesota Bankruptcy District Court case), as well as Pa. State Univ. v. Pa. Manufacturers’ Ass’n Ins. Co. (a recent Pennsylvania Court of Common Pleas case), to highlight the dramatic result in Minnesota and the distinct impact state law can have on trigger of coverage and determining the number of occurrences in these types of cases. The article discusses the different approaches taken by the two courts as well as how to approach these cases in states which have not yet addressed these issues.
