The Legal Intelligencer Publishes Attorney Eric Rosenberg’s Article on Personal Jurisdiction in Products Liability Litigation

Rosenberg authored an article "Strategic Considerations Before Challenging Personal Jurisdiction in Products Liability Litigation," in the January 30, 2018 issue of The Legal Intelligencer. Rosenberg is a skilled litigator and has represented many corporations and insurance companies in a wide variety of matters, including product defect litigation.

Rosenberg's article sheds light on several US Supreme Court cases that have contributed to a dramatic shift in the landscape of personal jurisdiction law over the past seven years.  The article poses an open-ended list of considerations for defense counsel that may make waiver of challenges to personal jurisdiction an attractive option, allowing attorneys to litigate in a challengeable forum with other potentially liable co-defendants rather than litigate among fewer defendants in a forum that is more jurisdictionally appropriate. The article addresses practical and legal considerations that may impact the decision to challenge jurisdiction, including: legal and expert costs, exposure to discovery, joint and several liability, allocation of fault to nonparties, and employer immunity.
