Partner Deanna Rader and senior counsel Jamie Mayrose prevailed in a three-day evidentiary hearing to affirm the award of a towing contract for their client, a national towing company.
The case arose when Plaintiff, an unsuccessful bidder on the contract, filed a preliminary injunction to prevent the local municipality from awarding the contract to Gordon & Rees’ client. Plaintiff complained that the municipality had acted arbitrarily and in violation of city code in making the award of the contract.
Ms. Rader and Ms. Mayrose acted quickly to intervene in the matter, which was strongly opposed by the Plaintiff. Given the short timeframe, the Court ordered discovery be completed in two weeks. The Gordon & Rees team attended eight depositions in two weeks and then drafted a persuasive trial brief that influenced the Court’s final ruling. Following the Court’s denial of Plaintiff’s claims, Ms. Rader then successfully defeated Plaintiff’s motion to stay the ruling.
The client congratulated the Gordon & Rees team for not only the favorable outcome, but for the manner in which they worked with the local municipality, a key customer. The client appreciated the goodwill established with the municipality and hoped it would lead to more work for his company in the future.
