The 42-year-old plaintiff filed suit in the U.S. District Court for the Middle District of North Carolina alleging several causes of action relating to claimed injuries from contact with an herbicide product.
Raleigh office managing partner Tom Packer and senior counsel Nick Wilson filed a motion to dismiss based on federal pre-emption and the sufficiency of the pleadings under heightened federal pleading standards.
The court granted the motion to dismiss in full and entered judgment in favor of the firm’s client.
