Gordon & Rees Raleigh partner Knicole Emanuel was interviewed and quoted in the article “Judge: State wrong to withhold Medicaid funds from provider.” The article highlighted a victory for Emanuel and senior counsel Robert Shaw in their representation of a behavioral health care agency that was forced to shut down after Medicaid payments were frozen due to fraud allegations.
“The Counseling Center was among 15 providers whose Medicaid funding was cut off in June 2013 after the Martinez administration announced that an audit had found ‘credible allegations’ the agencies had committed $36 million in Medicaid fraud over three years of submitting bills for treating low-income patients.”
On Friday, October 23, a Santa Fe judge declared a decision by Gov. Susana Martinez’s administration to withhold Medicaid funds from a behavioral health care agency “arbitrary, capricious or otherwise not in accordance with the law.” Emanuel stated, “The ruling also will set a precedent that mental health care agencies can use in their legal battles with the state.”
For more than 15 years, Knicole Emanuel has maintained a litigation practice, concentrating on Medicare and Medicaid litigation, health care regulatory compliance, administrative law and regulatory law.
Robert Shaw has extensive litigation experience, including representation of health care clients in Medicare and Medicaid litigation, provider disputes, administrative law, tax matters, complex business litigation, and regulatory compliance.
