On June 8, 2021, a Gordon Rees Scully Mansukhani team led by California partner Brian Ledger and Philadelphia partner Megan Bailey as second chair obtained a unanimous defense verdict before a 12-person jury in Philadelphia state court.
The plaintiffs alleged that exposure to benzene from the firm's client’s paint stripper caused the plaintiff’s blood cancer known as Myelodysplastic syndrome ("MDS"). The plaintiffs were represented by two attorneys from separate offices who specialize in benzene exposure cases and try such cases around the country. The plaintiffs chose to focus on the firm's client as the target defendant in the case by dismissing all but one other of the many defendants before trial. The other remaining defendant was a supplier of benzene to the firm's client. Plaintiffs sought damages in excess of seven figures.
