On August 23, 2021, Philadelphia Partner Lori Quinn with the assistance of Senior Counsel, Matthew Johnson, won summary judgment in a class action lawsuit brought against its client under the Fair Debt Collection Practices Act ("FDCPA"). The Court relying upon Spokeo and the recent Ramirez v. TransUnion decisions, granted summary judgment finding the plaintiff lacked standing. The Court found the plaintiff did not suffer a concrete harm regarding a fraud affidavit letter sent to her because the plaintiff neither saw nor read the letter, because she was unable to read or comprehend the English language.
The Court held these factors could not have resulted in confusion as to her rights or that she was otherwise harmed. Oh v Collecto, Inc., USDC NJ, 20-cv-01937-KM-ESK.
