Gordon Rees Scully Mansukhani Chicago attorneys, Daniel Feinberg and Jonathan Federman, recently secured summary judgment for their client in an insurance coverage dispute. The underlying complaint was a breach of contract claim as to cracks that developed in an in-ground swimming pool. The Court held there was no duty to defend as the underlying complaint did not allege damage to separate property or bodily injury, and there was insufficient facts alleged to support that the pool popped up to trigger an exception to an exclusion.
