A Gordon & Rees team comprised of Oklahoma partner H. Barret Marshall, Jr., and associate Dean Y. Drew successfully obtained a complete dismissal of all claims against a prominent travel company based in Tulsa, Oklahoma. The plaintiff asserted causes of action for: (1) breach of contract; (2) insurance bad faith; (3) fraud; and (4) violation of the Oklahoma Consumer Protection Act. The Gordon & Rees team moved to dismiss these claims pursuant to Title 12 Okla. Stat. § 2012(b)(6). Gordon & Rees’ motion, focused on the dichotomy between the services provided by the travel agent client and the principal duties of a third-party insurer, which led to a voluntary dismissal by the plaintiff of all claims against the travel company client.
