In the Central District of California, the plaintiff filed a Complaint for (1) federal trademark infringement, (2) state common law trademark infringement, (3) federal and state unfair competition. In this contested suit, the Gordon & Rees team asserted successful defenses and counterclaims including (1) Declaratory Relief of Non-Infringement, (2) Cancellation of Registration under Genericness and Descriptiveness, (2) Declaratory Judgment of Invalidity and/or Unenforceability, (3) Fraud on the Trademark Office, and (4) Abandonment of the Marks.
