Gordon Rees Scully Mansukhani New Jersey Partner Roy Viola obtained a dismissal for his luxury brand talcum powder client in a wrongful death action.
The estate claimed that the client, an internationally-recognized brand of high-end luxury products, manufactured several talc products that were allegedly contaminated with asbestos. Mr. Viola aggressively defended the company against these claims, demanding that plaintiff produce evidence the client ever made or sold the products at issue.
Rather than face a potentially costly motion that could involve costs, the plaintiff ultimately granted the Gordon & Rees team's demand for an outright dismissal with prejudice. The dismissal saved the client tens of thousands of dollars in defense costs and continued a string of good results for the client in New Jersey.
