Gordon & Rees New York Partner Erik DiMarco and Senior Counsel Jacqulyn N. Simmons successfully obtained a complete dismissal of all allegations against their client, an elevator company, in a case pending in New York County, New York.
The plaintiff alleged sustaining personal injuries when an elevator in which he was riding fell and came to an unexpected stop. He brought claims against the firm’s clients for negligence and carelessness in the maintenance of the elevator. Gordon & Rees was successful in proving to the court that the plaintiff’s claims had no merit. Their client's contract for services to the premises was terminated a little over a month prior to the incident, and their client did not exercise any control over the elevator at the time of the plaintiff’s alleged incident.
