Gordon Rees Scully Mansukhani Partners Alyson Cabrera and Michael Bruno obtained a complete defense verdict in U.S. District Court (San Francisco) following a two-week jury trial in a medical whistleblower case.
The defense team represented the defendant, Lucile Salter Packard Children’s Hospital ("LPCH") at Stanford, which operates a Neonatal Intensive Care Unit – Level 4, which is a specialized nursery for critically ill newborns. The plaintiff, a former Patient Care Manager, alleged that she made complaints about unsafe patient care and conditions while employed at LPCH. She claimed she was wrongfully terminated in violation of public policy, in retaliation for her alleged complaints. At trial, the defense team presented evidence that the plaintiff failed to engage in a protected activity and that LPCH terminated the plaintiff’s employment due to her inadequate job performance.
After deliberating for one day, the jury delivered a unanimous defense verdict in favor of the hospital.
