GRSM Partner Roy Viola secured a full dismissal on behalf of a prominent talcum powder cosmetics manufacturer in a case involving the same plaintiff as a prior lawsuit in Allegheny County, Pennsylvania.
The plaintiff alleged that she had used the client’s talcum powder-based cosmetics throughout her life and claimed that these products were contaminated with asbestos. In response to the second lawsuit, GRSM mounted a robust defense, filing preliminary objections aimed at obtaining an early dismissal. Viola argued that the plaintiff failed to include necessary parties, specifically all defendants from the initial lawsuit, thereby undermining her claims against the client.
Following oral argument on the motion, the plaintiff agreed to voluntarily discontinue the lawsuit against the manufacturer. This dismissal marks the second successful outcome achieved by Viola in a Pennsylvania talc case in October 2024, highlighting the effectiveness of an aggressive defense strategy in complex litigation.
