Gordon Rees Scully Mansukhani Partner Amanda A. King and Associate Brittney A. Nochimson obtained a complete dismissal of an arbitration proceeding in New Jersey involving claims of securities fraud, fraudulent conveyance, and negligent and fraudulent misrepresentation wherein the claimant sought hundreds of millions of dollars in damages.
The claimant filed for arbitration in connection with a financing agreement that he executed with GRSM’s client, which was subsequently assigned to a financial institution. After the parties exchanged relevant documentation, the GRSM team moved for summary judgment, arguing that the claimant had no standing and that there existed a complete absence of any legal or factual support for his claims.
After a full briefing, the arbitrator agreed with King and Nochimson’s arguments and dismissed all of the claimant’s allegations with prejudice, prohibiting the claimant from bringing additional proceedings.
