GRSM Boston Partner Stephen Orlando and Law Clerk Brennan Quigley recently obtained a voluntary dismissal of a personal injury lawsuit after uncovering evidence of fraud.
The plaintiff had alleged that GRSM’s client rear-ended his vehicle while it was lawfully parked, resulting in significant spinal injuries and a tear to his left inferior labrum. The plaintiff sought over $250,000 in damages for medical expenses, lost wages, and pain and suffering.
Through their investigation, Orlando and Quigley discovered video surveillance footage that exposed critical inconsistencies in the plaintiff’s claims. The video showed the plaintiff exiting his vehicle and entering a nearby restaurant prior to the alleged accident, contradicting his assertion that he was in the car when it was struck. Additionally, the footage revealed that the plaintiff had illegally parked his vehicle, further undermining his credibility. The surveillance also demonstrated that the plaintiff had fabricated the extent of his injuries.
Upon presenting the video evidence to the plaintiff’s counsel, Orlando and Quigley secured a voluntary dismissal of the complaint, ensuring that GRSM’s client would not be required to make any payment. This favorable outcome highlights GRSM's commitment to thorough investigation and effective defense strategies in protecting clients from fraudulent claims.
