San Francisco Senior Counsel, Sara Moore, will participate in an in depth panel discussion on "Tip Sharing: To Do or Not To Do?" during a morning breakout session from 11:15 a.m. to 12:30 p.m. on Monday, April 15. Moore's panel will examine the ongoing legal debate regarding tip sharing with back of the house employees. California historically prohibited tip sharing with back of the house employees. However, the Department of Labor issued new guidance last year, which questioned this historical practice. Concerns over the ambiguity of the tip pool led Congress to take action, clarifying that tips could be shared with everyone except for managers and owners. With this legislative change now a year old, some restaurants have adopted tip sharing, while others have waited to see how it fares with service staff at other restaurants.

Sara Moore is senior counsel in the San Francisco office of Gordon Rees Scully Mansukhani. She often provides legal advice to restaurant management and Human Resources personnel on a wide-range of employment matters including how navigate California law, avoid lawsuits, improve policies, and wage and hour compliance. Marie Trimble Holvick is a partner in the Employment practice group, and the National Employment Chair of the Firm’s Retail & Hospitality practice group. She also serves as the Assistant Managing Partner of the Bay Area offices. She is an experienced trial attorney with expertise in handling employment matters involving allegations of discrimination, harassment, retaliation, and wrongful termination. Holvick also regularly handles lawsuits involving class action “wage and hour” violations and PAGA claims. In addition to her litigation practice,she regularly provides advice and counseling, drafts employee handbooks, conducts harassment and management training sessions, and performs workplace investigations. Holvick is also very active in the hospitality industry, and has developed an expertise in defending restaurants, wineries, and hotels in employment and ADA litigation.
