Gordon Rees Scully Masukhani San Francisco Partner Marie Trimble Holvick authored an article "New Class Action Threat: Surcharges" in the September 18, 2018 issue of the Golden Gate Restaurant Association's (GGRA) Restaurant Association News.
In her article, Holvick explains that while surcharges are legal, the laws on consumer notices about surcharges are unclear. Holvick recommends that restaurants protect themselves by making their surcharges publicly visible in order to provide sufficient notice to consumers.
