Gordon Rees Scully Mansukhani partners Mollie Burks, Heather Gwinn Pabon, and Lindsey Romano will present “Hot Topics in Employment Litigation” for LeadingAge's Annual Meeting + Expo to be held in Denver, Colorado October 16–19.
This session will explore the increasingly difficult employment issues that arise for nursing homes and assisted living communities to navigate given national staffing shortages, a global pandemic, and a changing legal landscape. The Gordon & Rees employment litigation team will identify the leading legal pitfalls that healthcare providers face and will provide practical tips for avoiding those pitfalls. They will focus on state employment laws, including those governing unpaid wage claims, non-compliant meal periods, and unreimbursed business expense claims. They will also explore national legal trends focusing on COVID leave, supplemental leave, arbitration agreements, and the hiring of nurses through staffing companies and agencies.

Their membership now includes the home-based care providers of the Visiting Nurse Associations of America.
Ms. Burks is a senior partner in the firm’s San Francisco, Oakland and Los Angeles offices. She concentrates her practice on defending employers against complex wage and hour class, collective, and representative actions arising in industries including health care, retail, hospitality, finance, entertainment, and manufacturing. She also has a long history of successfully litigating wrongful termination and discrimination cases through trial. In addition to litigation, she provides a full range of employment law counseling, audit and training services.
Ms. Gwinn Pabon is the Managing Partner of the firm’s Nashville office. She handles a broad spectrum of commercial litigation claims on behalf of small and medium-sized businesses, public and private entities, and Fortune 500 companies against single plaintiff and class and collective actions.
Ms. Romano is Assistant Managing Partner of the firm’s San Francisco and Oakland offices and serves as co-chair of the firm’s national Health Care practice group. She is dual licensed in California and Florida and handles cases throughout the country in state and federal court. She focuses her practice on representing both nationwide and local skilled nursing facilities, assisted living facilities, and also represents home health care companies and nurses. In addition to long term care, Ms. Romano has significant experience representing acute care and behavioral health facilities, as well as medical professionals in malpractice and regulatory claims. She specializes in handling the most sensitive claims, typically involving wrongful death, catastrophic injury, and sexual or physical assault of the most vulnerable patient population from the onset of the claim through trial.
